SETTING HEARINGS:

To set hearings, the quickest way to accomplish this is to email my Judicial Assistant, Becky Knipe, at bknipe@circuit5.org.  Please carbon copy opposing counsel when doing this, in order to avoid any ex parte communications.  This also prevents any confusion by having a record of setting the hearing.  The information required for setting the hearings are, the case number; case style; purpose of the hearing and how much time do you need for that hearing.  My Judicial Assistant will then provide the parties with multiple dates.  Once the parties have agreed on a date and time, send an email back.

Before filing a notice of hearing, please wait until you get a CONFIRMATION from the Judicial Assistant or it will not be on the court calendar.  ALL HEARINGS WILL BE IN COURTROOM 2D, UNLESS SPECIFIED.  Also, if you intend on cancelling a hearing, please email bknipe@circuit5.org and put in the SUBJECT LINE – CANCELLATION OF HEARING FOR (WHATEVER DATE).  If you file a Notice That Action is At Issue, please email bknipe@circuit5.org with a copy of that.  If you settle a case, please email bknipe@circuit5.org so the case can be taken off any dockets that may pending, and also include the dates the hearings were scheduled.

Parties may appear telephonically by using Court Call, but must be set up in advance at 888-882-6878.  This is for non-evidentiary hearings. No motion or order is necessary of hearings of 15 minutes or less. If a party wishes to appear by Court Call for more than 15 minutes, there must be an agreement of the parties or order granting the telephone appearance.

Notice to the Public
The Code of Judicial Conduct governing behavior by judges forbids the Judges of the Fifth Judicial Circuit to discuss pending cases with the public. Please do not call the Court expecting to speak with a Judge about any case. The Court is only allowed to consider arguments made in the courtroom and in documents properly filed by actual parties in the case as authorized by law and the Rules of Court. The Court cannot ethically read or consider any other opinions or arguments about the case. Communications that do not meet these legal requirements cannot be forwarded to the Judges.
