The Marion County Adult Drug Court Program is a court supervised intensive and highly structured program consisting of both comprehensive out-patient treatment and case management supervision for non-violent offenders. The program includes, but is not limited to, regular court appearances, random drug screens, group/individual substance abuse counseling and frequent 12-step meetings attendance (AA/NA/CA). The length of this IV-phase program is normally 12 to 18 months.
If you meet the criteria to enter the Drug Court Program and your application has been approved by the State Attorney's office, you will be noticed to appear before the Drug Court Judge. If the Judge approves your entrance to the program, you will be required to enter a guilty plea to your charges and sign a prosecution agreement before entering the program. Your sentencing will be deferred for 18 months. Upon successful completion of the program the court will dismiss these charges against you.
CRITERIA:
Those persons who are eligible include:
- Any first time offender or any person previously convicted of not more than one non-violent misdemeanor, who is charged with a felony of the third degree, prostitution or second and third degree felonies involving purchase or possession of a controlled substance, solicitation for purchase of a controlled substance, or obtaining a prescription by fraud.
Those persons who are
not eligible include:
- Persons charged with a crime involving violence.
- Persons charged with a crime that includes sale or trafficking of a controlled substance.
The Marion County Adult Drug Court Program includes incentives to address progress and sanctions to address violation of the drug court rules, continuing drug use and other non-compliant behavior.
PHASE I - 16 WEEKS
(Minimum)
- Orientation, Assessment and Introduction to Treatment
- Develop an Individual Treatment Plan (ITP)
- No alcohol or drug use
- Daily color line calls
- Random drug screens
- Monthly Court appearances or as instructed by the court or drug court staff
- Minimum of two (2) hours of Group or other counseling weekly
- Individual Counseling sessions as instructed by the counselor
- Attend regular meetings with case manager or counselor
- Obtain full time employment, be involved in an academic/vocational training program or perform community service hours
- Attend at least four (4) 12-step meetings (AA/NA/CA) per week with proof of attendance
- Obtain a 12-step meeting (AA/NA/CA) home group
- Obtain a 12-step meeting (AA/NA/CA) sponsor
- Make all scheduled drug court payments as instructed by the Judge or drug court staff
- Community service hours as directed by the Judge or drug court staff
- Follow all Drug Court Rules and Guidelines
PHASE II - 16 WEEKS
(Minimum)
- Ongoing review and updating of treatment plan
- No alcohol or drug use
- Monthly court appearances or as instructed by the court or drug court staff
- Daily color line calls
- Random drug screens
- Minimum of two (2) hours of Group or other counseling weekly
- Individual Counseling sessions as instructed by the counselor
- Development of a relapse prevention plan
- Attend regular meetings with case manager or counselor
- Obtain/maintain consistent full time employment, school, vocational training or performance of community service hours
- Attend at least three (3) 12-step meetings (AA/NA/CA) per week with proof of attendance
- Focus on employment and/or education goals
- Make all scheduled drug court payments as instructed by the Judge or other drug court staff
- Other case management services as determined by the drug court treatment team
- Community service hours as directed by the Judge or drug court staff
- Follow all Drug Court Rules and Guidelines
PHASE III - 16 WEEKS
(Minimum)
- Ongoing review and updating of treatment plan
- Drug and alcohol free lifestyle
- Monthly court appearances or as instructed by the court or drug court staff
- Daily color line calls
- Random drug screens
- Minimum of one (1) hour of Group counseling weekly
- Individual Counseling sessions as instructed by the counselor
- Attend regular meetings with case manager or counselor
- maintain full time employment, school or vocational training
- Attend at least two (2) 12-step meetings (AA/NA/CA) per week with proof of attendance
- Focus on employment and/or education goals
- Make all scheduled drug court payments as instructed by the Judge or other drug court staff
- Community service hours as directed by the Judge or drug court staff
- Other case management services as determined by the drug court treatment team
- Follow all Drug Court Rules and Guidelines
PHASE IV - 20 WEEKS
(Minimum of 4 weeks)
- Fulfill goals of treatment plan
- Drug and alcohol free lifestyle
- Develop and obtain an aftercare plan
- Monthly court appearances or as instructed by the court or drug court staff
- Daily color line calls
- Random drug screens
- Minimum of one (1) hour of Group counseling bi-weekly or as directed by the drug court treatment team
- Individual counseling sessions as instructed by the counselor
- Attend regular meetings with case manager or counselor
- Maintain consistent full time employment or school, vocational training with proof provided monthly
- Attend at least two (2) 12-step meetings (AA/NA/CA) per week with proof of attendance
- Community service hours as directed by the Judge or drug court staff
- Be up to date with all drug court payments
- Follow all Drug Court Rules and Guidelines
PHASE ADVANCEMENT
Advancement through the phases is contingent on participant meeting all treatment and financial obligations.
PROGRAM FEES
Each participant is required to pay a $35.00 application fee and if accepted, the participant is required to pay an additional $500.00 participation fee within the first 90 days of program acceptance. All payments will be made according to a fee schedule and are non-refundable. All payments shall be made by money orders payable to: Marion County BOCC.
