*NOTICE TO THE PUBLIC:* The Code of Judicial Conduct governing behavior by judges forbids the Judges of the Fifth Judicial Circuit to discuss pending cases with the public. Please do not call the Court expecting to speak with a Judge about any case. The Court is only allowed to consider arguments made in the courtroom and in documents properly filed by actual parties in the case as authorized by law and the Rules of Court. The Court cannot ethically read or consider any other opinions or arguments about the case. Communications that do not meet these legal requirements cannot be forwarded to the Judges.

Please be sure to include your case number, the total amount of time being requested by all parties as well as the motion that is to be heard. The Judicial Assistant will respond with your hearing time. It is YOUR responsibility to file a Notice of Hearing.
Exhibits: Ten days prior to any hearing submit all evidence you intend to rely as pre-marked exhibits via PDF format to opposing counsel or pro se party and the Court to the following email address: egoyeneche@circuit5.org
Scheduling a motion for summary judgment of foreclosure case:
- Request hearing date and time using the ONLINE SCHEDULING – COMING SOON. Once the hearing is confirmed, the zoom information will automatically be generated.
- Download the mortgage foreclosure summary judgment checklist. Complete in full and submit via e-filing along with all of the other required supporting documentation 10 business days prior to the summary judgment hearing.
- The attorney appearing before the court at the hearing shall re-certify the accuracy of this checklist to the court. The court and clerk will rely upon the attorney’s certification that the information on the checklist is accurate.
- A proposed final judgement, any exhibits, and all procedural questions are to be emailed ten days before any scheduled final hearing to egoyeneche@circuit5.org and opposing party or opposing party attorney.
