NOTICE TO THE PUBLIC: The Code of Judicial Conduct governing behavior by judges forbids the Judges of the Fifth Judicial Circuit to discuss pending cases with the public. Please do not call the Court expecting to speak with a Judge about any case. The Court is only allowed to consider arguments made in the courtroom and in documents properly filed by actual parties in the case as authorized by law and the Rules of Court. The Court cannot ethically read or consider any other opinions or arguments about the case. Communications that do not meet these legal requirements cannot be forwarded to the Judges.

Please contact the Judicial Assistant to request any required hearing date.

It is your responsibility to do a Notice of Hearing and comply with the all Procedures & Administrative Orders and to provide courtesy copies and proposed orders.

Civil

*Please submit all civil orders in word format to the Judicial Assistant, Josephine White at jwhite@circuit5.org.
*No party is allowed to cross-notice a hearing without permission from the court.

Probate

*If a probate proceeding is adversarial, the parties must comply with all civil non-jury orders. See below for a few procedural orders regarding Judge Vergara’s civil non-jury docket.

*Please submit all probate orders in word format to the Judicial Assistant, Josephine White at hernandoprobate@circuit5.org.
*No party is allowed to cross-notice a hearing without permission from the court.

Surplus
Guardianship

HEARINGS: Hearing times for guardianship cases may be obtained by sending an email to jwhite@circuit5.org. Please include the case number, petition/motion to be heard, and an estimate on the time needed for the hearing. If the hearing is evidentiary, please indicate all witness names and a list with copies of any proposed exhibits.

After obtaining the date for hearing that has been approved by the court, you must submit a courtesy copy of the notice of hearing to jwhite@circuit5.org to ensure that your hearing will be placed on the court’s hearing docket.

PROPOSED ORDERS: Please submit all proposed orders electronically in Word format to jwhite@circuit5.org at least two days before the hearing.

Please copy all counsel of record of any correspondence including the court-appointed attorney and any opposing counsel.
